How did he do it? With YouTube, that’s how. Kissed in his cradle by the witch of the Web, Justin was throwing up little promo reels by the time he was 12. Singing a Brian McKnight song into the bathroom mirror. Or sitting on some municipal steps somewhere, busking mightily about the Lord: “You’re my God and my Fa-ther!” he bellows through the legs of passersby, the wooden body of his guitar reverberating with his shouts. ...


Bieber wasn’t from the Disney factory, and he didn’t have a show on Nickelodeon, so the marketing plan was skewed toward his already established constituency in social media: lots of Facebooking and YouTubing and sugary tweets to his millions-strong Twitter army.









Another day, another honking big funding for another online start-up (and yet another broken embargo too!).


It’s like Groundhog Day in Silicon Valley as usual.


Today, Cambridge, Mass.-based HubSpot wins tech’s version of the lottery, grabbing $32 million from Sequoia Capital, Google Ventures and also Salesforce.com.


It is unclear what the valuation for HubSpot is now, although it is likely high given it has raised $65 million now.


HubSpot makes marketing software for businesses, who use it to find prospects and generate leads, along with tools to analyze the process. It claims it has “4,000 customers, over 50 percent market share, five million leads managed, and 70 million page views tracked monthly.”


The Series D financing included HubSpot’s existing venture investors–General Catalyst Partners, Matrix Partners, and Scale Venture Partners–and part of it will be used to cash out existing shareholders. In previous rounds, the start-up has raised $33 million.

The major legislative item on the agenda in the Senate this week will be The Small Business Reauthorization Act (S. 493).  Republicans plan to use this bill as a platform to promote critical pieces of legislation through the process of non-germane amendments to the bill.  Here are some vital amendments that will be debated and voted on throughout the week:



  • Senator Mitch McConnell is offering an amendment (S. AMDT 183) to prohibit the EPA from promulgating any regulations on greenhouse gas emissions.  There is perhaps no force that is more destructive to our prosperity, consumer freedom of choice, and job creation than onerous cap and trade schemes.  There are many red state Democrats who are up for reelection in 2012 and will be hard pressed to go on record as supporting policies that are an imprecation to the interests of their states.  Make sure to call Senators Claire McCaskill, Joe Manchin, Ben Nelson, Bill Nelson, and Jon Tester in particular.



  • Senator David Vitter is offering an amendment (S.AMDT. 178) forcing the federal government to sell off unused and underused property.  This is a serious issue.  The federal government owns over half of the land in some western states and has been using it to stifle energy development.  Selling unused federal lands would also serve as a prudent means of generating revenue without raising taxes.



  • Senator Rand Paul is using the SBA bill as a platform to offer his signature budget bill (S.AMDT 199) which would slash $200 billion in spending for fiscal 2011.  Paul’s plan slashes funding by 50% to the Departments of Energy, Education, and HUD.  This amendment represents real limited government and budget austerity and will separate the men among the boys in the ranks of the Republican Conference.



  • Senator Kay Bailey Hutchison is forcing a vote (S. AMDT 197) to delay the implementation of ObamaCare until a final resolution is reached in pending lawsuits.  Unlike other bills that are designed to merely ameliorate ObamaCare, this amendment would completely halt it during the ensuing legal battles.



  • Senator Tom Coburn has filed an amendment (S.AMDT.184) to force federal agencies to compile comprehensive lists of all of their programs


Make sure that all of your Republican senators are on record supporting these amendments, especially Rand Paul’s budget proposal.  Also, let’s see which faux moderate Democrats will commit to supporting anyone of these commonsense initiatives.  Needless to say, I didn’t waste time calling my senators; Barbara Mikulski and Ben Cardin!



What’s affecting me, my clients and other small-business owners this week.


THE QUAKE IN JAPAN, A GOOFBALL IN VENEZUELA Japanese earthquake damage is estimated at $310 billion and could be the costliest natural disaster ever. Japanese exports suffer. Kate Rogers of Fox revisits how to protect your business from catastrophe. “Small-business owners can determine if they should be seeking disaster coverage by weighing their investment in the business itself, among other factors. If the business is the sole form of income, the risk is much greater than if it is a hobby or part-time project.” Elsewhere around the world, the war industry gets a boost in Libya. And Hugo Chávez of Venezuela says capitalism may have destroyed life on Mars.


REAL ESTATE FALLS, JOBS RISE Mark Thoma says commodity prices are increasing because of world demand. A small-business owner in Georgia is trying not to pass on the cost of high gas prices. Detroit’s population declines 25 percent. Existing-home sales fall to the lowest on record. Meredith Whitney, an investment adviser, says, “Unless the government comes out with a 50-year mortgage, this market is in trouble longer term.” Gallup’s job-creation index is the highest since September 2008. Durable goods orders fall.


ANNE HATHAWAY AND WARREN BUFFETT The Fed earns $79 billion and predicts that the recovery is taking hold. Nonetheless, one of its officials warns that the United States is approaching insolvency. Meanwhile, Warren E. Buffett predicts growth but some think his company’s stock is buoyed by Anne Hathaway. Household balances sheets continue to improve. Scott Grannis says “the Philadelphia Fed Business Outlook Survey came in very strong. It hasn’t been this strong since the economic boom times of the early 1980s. It’s very difficult to ignore the mounting evidence of a strong economic recovery.” Architect billings increased slightly in February.


DEFICIT THRILLS The Committee for a Responsible Federal Budget is thrilled to see 64 senators calling for comprehensive deficit reduction. But Stan Collender, a budget expert, isn’t thrilled at all: “Does a letter that is so vanilla that it could have been written at any time over the past 40 years really indicate any movement on the current budget debate?” James Pethokoukis of Reuters says he thinks President Obama’s budget is wildly dangerous.


A NEW DEFINITION OF SMALL BUSINESS Timothy F. Geithner says that American small businesses need greater access to capital to spur innovation. The Small Business Administration, facing even more cuts, is for the first time in more than 25  years proposing to change the way it defines small businesses. JPMorgan Chase says it will cease its debit card rewards program because of new legislation that would restrict fees. Missouri gets $27 million in incentives for small-business growth. The Small Business Savings Account Act makes its way through Congress.


TAKING CREDIT The health care legislation celebrates its first anniversary and Ezra Klein defends it by saying, “Is it a perfect piece of legislation? Not even close. Will everything work as expected? Almost certainly not. But for all its flaws, it’s a good law. And it’s worth trying.” Many small businesses are still not taking advantage of the health care tax credit.


TECHNOLOGY UPGRADES A Google project manager pitches cloud computing: “Web-based software is much less costly for buyers than traditional software, and programmers can be so much more innovative, that it’s worthwhile for an entrepreneur to say, O.K., let’s start from scratch.” Paul Mah, an information technology expert, gives us eight reasons to upgrade to Internet Explorer 9. Firefox 4 is released. Microsoft jumps to second in video search and introduces a new PC tool for small business. Netflix suffers an outage. BlackBerry’s tablet is scheduled to arrive in April. AT&T buys T-Mobile but not for the reason you think. And boy. has computer technology come a long way in 10 years.


THE GROWING APPS MARKET Information Week reports that 38 percent of small- and medium-size businesses depend on mobile apps. Amazon introduces an Android app store, and Apple is not pleased. Minda Zetlin of Inc. asks if you should make a tablet app for your business: “The answer is likely a yes if one, your product or service is one where having tablet access could benefit customers; and two, your customers are the type who use tablets.” Just in time: a flood of royal wedding apps.


SPEAKING OF THE BIG WEDDING General Electric releases a much-needed William and Kate refrigerator. Jack Daniels introduces a new product — perhaps to help us forget the royal wedding. Danny Wong gives us three winning ideas to consider. A dating site features a new single man every day. Score plans an e-business learning Web site for small business. Small Business Television is rebranding itself and has introduced a new Web site. Small Business Opportunities magazine is doing the same. A small business introduces its first electric car. Sales of e-books have doubled. The group buying industry is projected to grow to $2.7 billion this year.


TWITTER’S TAX BREAKS Casey Hibbard explains how one company used social media to make $300,000 in a weekend. Robert Scoble discovers the future of work: “Just when we thought we figured out the new ’social enterprise’ market along comes Convofy.” Twitter shows San Francisco’s businesses how to save a bundle on taxes. A one-legged wrestler shows us how to become a national champ.


IT’S GOOD TO BE GREEN A woman in Canada gets a standing ovation for being green. The Manhattan Chamber of Commerce holds its green marketing event on Wednesday. The Clinton Global Initiative holds its university conference this week with a focus on entrepreneurship and a live webcast.


ADVICE FOR SXSW: HAND OUT PILLOWS The Global Entrepreneurship Congress meets in Shanghai this week. April 2 is International Pillow Fight Day. The South By Southwest conference: as seen from a bunch of social media video bloggers — which is yet another reason I won’t attend next year. American Airlines offers a big promo for California business travelers. John Jantsch wants to know the worst business advice you ever received. A third-base coach gives life advice.


SEARCHING FOR HELP WITH SEARCH An American Express survey finds that more than half of small-business owners say they need help with search-engine marketing. A video about why it’s not important to go viral goes viral. Dharmesh Shah shares a few low-cost advertising ideas for start-ups and cautions readers to “think of advertising not as a long-term traffic strategy but as a testing tool to improve your Web site and find out more about your ideal visitor.” An advertising blog discusses how to develop a relationship with the media. Lucy Thornton comes up with a few good marketing themes for April.


A 100-MILLION-MEMBER NETWORK LinkedIn officially reaches 100 million members. Seems like a good time to read the co-founder’s 10 rules for entrepreneurial success.


TRIED TALKING? Whitson Gordon of Lifehacker gives us his top 10 tricks for working while on the go. Making Money From the Internet



Comcast Chief Executive Brian Roberts let investors in on a little secret Wednesday during his keynote speech at the Morgan Stanley Technology, Media and Telecom conference in San Francisco.


The 51-year-old executive's biggest concern over the last  year was nothow best to fold NBC Universal into Comcast.  No, Roberts said, it was the transition to replace his No. 2 executive, Steve Burke, who had been in charge of the day-to-day operations of the company's lucrative cable business.


Last month, when Comcast took control of NBC Universal, Burke became chief executive of the television and movie company.  Burke surrendered his role and title of chief operating officer of Comcast.  Neil Smit -- who joined Comcast 13 months ago from cable company Charter Communications -- is now executive vice president in charge of all of Comcast's cable operations.


Roberts called the executive changes Comcast's "most important transition."


After all, Comcast's core business of cable TV, Internet and telephone service brings in $36 billion in annual revenue.  Comcast's programming business, which now includes NBC Universal, generates a little more than half that amount.


Despite dramatic changes underway in the media business, Roberts remains bullish on the company's prospects. Comcast raised its dividend last month and plans to buy back $2 billion in stock. The Philadelphia-based company, Roberts said, took control of NBC Universal at a particularly advantageous time. The NBC Universal businesses are now doing better than when the deal was first announced in late 2009, and Comcast needed less money than it had anticipated -- $6.2 billion in cash versus $6.5 billion at the time of the announcement -- to pay General Electric Co., which now has a minority stake in NBC Universal. 


The television advertising market has rebounded in the last year, and there's a new stream of revenue as cable companies begin to pay the broadcast networks for their programming.


Roberts said he expects NBC to help bolster Comcast's Golf Channel and Versus, a cable sports network. On the movie side, Comcast can use its clout to shorten the traditional period of time before movies become available on DVD and video-on-demand services, a benefit to Comcast customers.  And soon, NBC Universal programming will be available, joining Turner channels, HBO, Starz and Showtime, on Comcast's anytime, everywhere TV service, Xfinity TV, which now has an application available for the iPad.   


On Wednesday, Roberts suggested that the company's jewel is its broadband Internet service, which now has 17 million customers. That makes Comcast the largest Internet provider in the nation at a time when consumers are increasingly watching news and entertainment online.


"In the next 10 years, people will want more bits in their house than ever before," Roberts said, referring to Internet network capacity. And Comcast's investment in its high-speed networks should help it battle rivals that have cut into Comcast's customer base:  satellite TV providers and telephone companies AT&T and Verizon, which now offer Internet and TV channels.


"We are focused on broadband,"  Roberts said.  "The bet we are making is to be the best pipe. It's as simple as that."

I recently read about Matt Slauson, an NFL player, who has been pretty successful over the last few years but is now worried about his financial future. He's concerned about the NFL lock-out and what it might do to his income. Even though a player can have a decent contract, some of the money is usually an up-front bonus and the rest is performance-based.


Matt Slauson isn’t destitute by any means, but he decided to move his wife and baby into his parents’ house to lower expenses and boost savings. This seems like a drastic act in light of the fact that he was making hundreds of thousands of dollars per year, but money can get used up quickly if you expect it will never end or if you’re not paying attention. Matt is going with a prudent solution to a situation that hopefully will only be temporary.


When you live at home with your parents what are the real savings? Normally your housing costs take up approximately one third of your monthly basic budget. If you move in with your parents, they should be willing to continue to pay for those costs that aren’t affected by you being there, like the mortgage, home insurance, and taxes, or if they’re renting, then the monthly rent.

It said the group also broke into the homes of two brothers, robbed them, and killed six people in a Nov. 11 attack in Kashgar.

 

The report gave no information about the victims or the schedule for the executions.

 

Three of the men were sentenced to death with a two-year reprieve, a sentence that is normally commuted to life imprisonment in China's judicial system.

 

They were convicted of deliberate homicide and armed robbery by the Kashgar Intermediate People's Court in the first instance.

Last month, the Supreme Court sentenced four Uyghurs to death for alleged involvement in an Aug. 19 bomb attack in Xinjiang’s western Aksu city.

 

The World Uyghur Congress pointed to concerns over lack of transparency in those cases too.

 

The Aksu blast left eight people dead, including two of the bombers, and 15 wounded after a man riding a three-wheeled vehicle threw explosives at a group of uniformed patrolmen. Four Uyghurs were arrested shortly after the attack.

 

State media characterized the cases as acts of terrorism and unrelated to longstanding ethnic tensions between Uyghurs and Han Chinese in the region.

Those frustrations erupted in July 2009 in deadly riots that left nearly 200 people dead, by the Chinese government's tally.

 

At least 26 people, mostly Uyghurs, were sentenced to death in the aftermath of the riots, many of whom have been executed, according to state media.

 

China is believed to execute more people each year than the rest of the world’s countries combined, although the government does not publish official figures.

 

Rights groups say Beijing may execute as many as several thousand prisoners annually.

 

Chinese authorities blame Uyghur separatists for a series of deadly attacks in recent years and accuse one group in particular of maintaining ties to the al-Qaeda terrorist network.

"From the point of view of ethnic minorities, the graduate work scheme is really taking the cream of youth from the minorities and using them to 'further cultural development,'" wrote one ethnic minority user on a popular microblogging service.

While I have a Ph.D. in business, I have frequently been too focused on my values to justify the business case for a lower carbon footprint. I guess I care too much about what we are doing to the planet and what we are leaving behind for my son, Mateo.


Along the way, I have learned a painful lesson that hopefully can help other aspiring climate capitalists: Most people and most industries don't really care about the planet or climate change. They care about things that matter to their pocketbook or to their bottom line. I am of course exaggerating a bit as, for example, most of the Triple Pundit readers care about the environmental and social impacts of their activities, not just the financial.


Most of us noticed that Obama's recent rhetoric about energy efficiency and renewables avoided the topic of climate change altogether. This is not because Obama suddenly doesn't care about climate change. It is that he has learned what messaging works with the American people. Jobs, economy, jobs, oh yes, and did I mention jobs?


How we frame the issues and opportunities related to the low-carbon economy is incredibly important. Too many of us, myself included, wear our passion on our sleeves and focus on the wrong issues in trying to help engage a skeptical public to make the transition.


This is of course why Peter Byck developed a documentary, Carbon Nation, (which I blogged about recently), a climate change solutions movie "that doesn't even care if you believe in climate change." This is also the reason why I cowrote the forthcoming book, Climate Capitalism with Hunter Lovins. We hope that by removing the "debate" about climate change from the conversation and focusing on the profits, jobs, and economic growth that can be achieved by making the switch to a low-carbon economy, we might have more of an impact on public discourse and private action.


When CO2 IMPACT first started promoting our services to the market, our messaging focused on our ability to help companies reduce their emissions and generate extra revenue by selling the carbon offsets into the market. My opinion now is that was definitely the wrong message. We now focus on showing how companies can save money, or make more money, by engaging in energy efficiency, fuel switching, or methane capture projects. Oh yeah, and by the way, you can make some additional revenue from offsets to improve the project return on investment and grow your "green" brand at the same time.


Take our coal mine methane projects in Colombia. There have been two explosions from excessive gas in underground coal mines in Colombia this year killing 26 people. Last year, more than 200 miners were killed in similar explosions. While there are socially responsible mining companies who are absolutely concerned about the health and safety of their employees, the best arguments to get clients to embrace coal mine methane capture projects are financial. Does anyone really think that Walmart is doing this because they have suddenly become treehugging liberals? I don't think so. They are doing it because they are saving money. And lots of it. And Walmart, yes Walmart, won the Aspen Institute's 2009 Corporate Energy Efficiency Award [PDF] because of this commitment.


GE has made major efforts to promote their low-carbon green solutions. Sure they use their campaign to build their green credentials, but mostly they are doing it to generate more green bills. The Ecoimagination program is generating more than $18 billion per year in revenues for GE.


In conclusion, my point is for all of us who care about the planet and want to be part of the transition to the low-carbon economy, we need to focus more on the economy part, and slightly less on the low-carbon part. That is the fastest way to get to 350 parts per million.

















Earlier this week, the Supreme Court heard oral arguments for Leland Stanford Junior Universotu v. Roche,  a case that will clarify a 1980 law that governs the ownership of patents held by universities that rely on federal research funds.


The case refers back to 1988, when Mark Holodniy, then a Stanford-employed researcher, developed technology that would ultimately lead to one of the first AIDS tests. It's used to monitor the effectiveness of AIDS treatments, using polymerase chain reaction assays to measure the level of hormones in the body. However, while Holodniy was employed by Stanford, he also signed a research contract with a private pharmaceutical company to work on a similar projects. While the patents were originally granted to Stanford, Roche has been selling the technology to hospitals since 1996.


In 2005, Stanford took Roche to a federal district court in San Francisco, arguing that Roche had infringed on the school's patents. Stanford won the case, but an appeals court reversed the decision. On Monday, the case was presented in Washington to the Supreme Court. Lawyers for Roche Molecular Systems, Inc. argued that Roche's contract with the private company trumps any existing agreement with Stanford. In a broader view, the Supreme Court will decide which interests to protect: those of the government (in this case the university), or those of private businesses.


While Stanford has maintained that it seeks the intellectual property for the patent—and not the cash it creates—it's clear that lucrative patents can be a huge money-maker for universities. "Not all university inventions make a lot of money," University of California-Davis law professor Peter Lee told KQED Radio's The California Report, "but some do. So there's potentially millions of dollars at stake in the outcome of this case."


According to Bloomberg, the "case may pit universities and the federal government against companies." The article also notes that the Obama adminstration, MIT, and the Association of American Universities are backing Stanford.


Roche, based in Switzerland, argued that universities were making "hyperbolic" claims about the impact of the ruling. Bloomberg quotes the company as arguing that: "Stanford's desire for private monetary gain has nothing to do with clarity of title or bringing valuable scientific discoveries to the public...On the contrary, Stanford's effort to exclude Roche from practicing the patented invention would reduce opportunities for the public to benefit from the invention."


More than 25 organizations, private companies, and individuals have offered amici curiae, or legal opinions, to the court. In one, jointly filed by the Intel Corporation, Eli Lilly and Company, and Johnson and Johnson, among others, the private companies asserted that if Stanford was granted patent rights, it could reduce opportunities for the public to benefit from the invention.


"Stanford's novel interpretation of the Act would discourage collaboration by allowing universities and other contractors to engage in predatory behavior," they wrote in the brief. "Under Stanford's view, for example, a university could attempt to escape its contractual obligations and terminate a commercial collaborator's rights in an invention simply by sprinkling the research project with a modest amount of federal funds."


But, the Obama administration, as well as a number of high profile academic organizations have urged the court to reverse the 2009 decision. They argue that federally funded research projects are "used to advance the public interest," as opposed to corporate projects, which are used in the pursuit of maximum profit. U.S. Solicitor General Neal Katyal said that siding with Roche would frustrate "the government's ability to protect the taxpayers' multibillion-dollar investments in research and development."
